Fiance(e) Immigration Journey

So these are the steps or the filings that a fiance(e) will normally do when he or she decides to go for the K1 or fiance(e) petition, from being a “fiance(e)” to finally becoming a citizen.

  1. I- 129F Application for the fiance(e) to come to the USA, this is the first step done by the petitioner/US citizen. If it gets approved, fiance(e) will have interview at the US embassy with her requirements
  2. I- 485 Application for Adjustment of Status,  this is done by the “fiance(e)/applicant” after the wedding to the petitioner/US Citizen
  3. I- 751 Application for Lifting of Conditional Status, this is filed by the “fiance(e)/applicant” 90 days  before his/her two year conditional permanent resident card  expires
  4. N-400 Application for Citizenship and Naturalization of the now Permanent Resident “Fiance(e)” after three years of residency

Of course every time you file you will have to pay the filing fee which is not cheap at all.

Anyway, I have completed the first three so I am now going to the path to citizenship. Hurray for me !

Form I-693

Below is an email from another K1 applicant who’s now here in the USA. I am posting it here for future reference for others should they go through the same thing.

Hi Inna, How are you? I hope you’re doing well.
I hope you still remember me. I’m now here in the US.

I’m now processing my permanent resident status. They’re sending me a letter asking for an additional evidence. They ask me to get a medical exam. the I-693 Form. Akala ko ba were done with our medical sa St. Lukes and that the immigration will forward the medical result to the US immigration where our papers are being processed? I can’t understand why are they asking for another evidence? They said that the immigration did not forward the medical result to California office. That’s not our fault, di ba?

Ang hindi ko ma intindihan bakit sila mag request ng another medical exam when we already done it in the Phils. I called one of their doctors here it’s gonna cost us $400!!! Ang mahal mahal!
The medical exam is just the same what we did in the Phils.

If you know anything about this, Please let me know. or did you undergo the same scenario.

From my experience, I did send in the I-693 along with the the I-485 when I filed for my adjustment of status. The reasons behind my submitting the I-693 with my I-485 is that first, I did not have any vaccinations done when I was in the Philippines because I was pregnant that time I had the medical and second, I remember that the lady from St. Luke’s told me that there is a vaccine that is not available in the Philippines, and we can only get it here in the US. So that may be the reason why all K1 applicants from the Philippines, need to be poked again, for this particular vaccine, aside from the ones that they had from the Philippines.

You need to go to a physician that is in the list of USCIS civil surgeons in your area, then he’ll refer you to the health center to get the particular vaccination that you still need. That way you don’t need to pay a lot. I only paid $20 or less for my vaccination, took the vaccination result to the USCIS physician then paid $75 for him to fill up the I693 form.

If you say that USCIS claims that they were not given the medical result for your exam, when you came here, after a week you received a copy of your medical exam result from St. Luke’s, right ? Now if you have that, you can bring it to to that USCIS physician so he can include it in your form I-693. He will be able to see from your vaccination supplement from St. Luke’s that you already had several of the required vaccinations. Hopefully he will be understanding of your situation, and will not insist that you take another medical examination again, at his clinic. If you don’t have that copy of the vaccination supplement that you had in Manila, then you can ask for a referral to take the necessary vaccination at the health center so it won’t be too expensive.

K-1 Petitioner Dies Prior to AOS Filing

My friend Belle arrived in the USA April 1, 2007 , got married to her American fiance who petitioned for her thru K-1 (Fiancee Petition) . Belle and Pete were happy and were blissfully enjoying their marriage but that happiness was suddenly cut short. After just 15 days , her husband got killed in a motorcyle accident. Belle have not yet filed for an adjustment of status since they may have thought it too early, after all, they were just married for two weeks. But now Belle is suddenly a widow, all alone here in the USA, and with no immediate family nor relatives to turn to. Her husband’s family are also overseas and hard – up for money too that they cannot even come here for Pete’s burial.

I live in California, Belle lives in Florida. Even if I want to help her, it is just too far. By the way, Belle and I became friends because I helped her with some of her K1 concerns before. I feel so sad for her , going thru her K1 ordeal, and finally coming over to the US but now unfortunately, she has to go through this tragedy, her husband’s death.

I am posting this because it is very important to all K-1 holders who come here. When you come here thru the K1 visa, get married immediately and file your adjustment of status right after. Because Belle and Pete did not file for her AOS after getting married, Belle has to go back to the Philippines before her 90 – day visa expires. The immigration lawyers she contacted all told her the same thing, that she will have to go home even if it is very unfair to her because that is the law here in the States. If only she and Pete applied immediately, pending the approval, it might have been a different result.

So file your adjustment of status immediately after getting married, okay?

Adjustment of Status Interview

This happened last February of 2006.

Had my Adjustment of Status interview yesterday at the USCIS office in 630 Sansome Street, San Francisco… came in at the office at 9:30 AM, got called after 5 minutes and was out of the USCIS office before 10 AM. fast huh ?

the interviewer was a Filipina ( sayang , I have been looking forward for a foreigner pa naman… ) but did not speak any Filipino so me and husband spoke in English too. Right away, she told me that she will not be able to approve it since they are still waiting for the security clearance that FBI is doing in my name. Well ,after the 9/11 they are exercising very strict guidelines with new immigrants , so that’s understandable I guess so I’m cool about it. I know that they will find nothing against me so I don’t have any worries at all.

Anyway, the interview was fast, did not have any problems at all. She just made us swear or take an oath that everything we say would be the whole truth and nothing but the truth …. the same oath I took when I had my embassy interview in the Philippines. She asked for my SS number, my passport, and she also crossed out my US visa thereby cancelling it. She also took my I-94 form , the form I filled up during my entry to the US. We had a little chitchat too about the baby’s facial rashes but after that it was all formal and she proceeded to ask if I have ever been to the US, if I have ever been convicted of any crime, or that If I plan to commit any felony, prostitution etc…(the last one made me think, duh?? I am such a good girl noh. hello ??!!! ) Baby is getting impatient so he kept on whining, I think the lady wanted to get rid of us fast so she just asked for any proof for our genuine marriage so we gave her a copy of our joint bank account, the medical and dental ID cards. we also showed copy of the check from IRS under our names since we filed jointly. after that she said I just had to wait for my greencard in the mail…

At last and finally, that was over… whew!!!

Update:

May 12, 2006, approved AOS , will receive the card in the following weeks..

May 23, 2006 , finally received my conditional, permanent resident card in the mail.
